Legislative changes

Over the next 12 months, legislative changes will come into effect to support recent amendments to the NVR Act.

The advice we published in July has been updated to include these key changes to supporting legislation, which were announced in early August 2020, and which come into effect from 1 September 2020.

For example, changes include ASQA’s ability to issue an infringement notice where an RTO issues a testamur to a student without ensuring that student holds a Unique Student Identifier (USI), unless the student is exempt. Similarly, ASQA can issue an infringement notice if an RTO fails to comply with a direction by ASQA to cancel a VET qualification or VET statement of attainment. These changes provide alternatives to civil penalty proceedings.

The way ASQA publishes information to the National Register will change, with ASQA required to include a broader range of information about an RTO as well as historical regulatory decisions about an RTO. Additionally, from 1 March 2021, ASQA will be required to publish regulatory decisions on the National Register at the time of the decision.
