False or misleading representations
The existing offences regarding false or misleading conduct have been strengthened by clarifying and extending what is considered prohibited conduct by an RTO. This includes representations (whether via advertisement or other means) that relate to:
- all or part of a VET course; or
- a course that is held out as being a VET course; or
- part of a course that is held out as being part of a VET course; or
- a VET qualification; or
- a qualification that is held out as being a VET qualification; or
- the organisation’s operations.
The amendments also provide that an Executive Officer of an RTO may in certain circumstances be personally liable for an offence committed by their organisation in relation to false and misleading representations.
