Updated statement on TAFE SA (RTO 41026)
The Australian Skills Quality Authority (ASQA) has announced that it will revoke its 1 December 2017 regulatory decision to suspend ten qualifications from the registration of TAFE SA (RTO ID 41026). ASQA has today issued TAFE SA with a written direction to rectify minor outstanding non-compliances in relation to its delivery of vocational education and training.
TAFE SA was subject to routine regulatory scrutiny in May 2017 that identified some non-compliance with the requirements of the Vocational Education and Training (VET) Quality Framework. As a result, in September 2017, ASQA issued TAFE SA with a notice of intention to suspend a total of 16 qualifications from its scope of registration.
The response provided by TAFE SA to the notice of intention did not address all of the non-compliances identified. As such, on Monday 4 December 2017, ASQA formally advised TAFE SA of its decision to suspend 10 qualifications from its scope of registration as a provider of vocational education and training.
Where ASQA makes a decision to impose a regulatory sanction, there are several review mechanisms available. These mechanisms include an internal ‘reconsideration’ of the decision by ASQA, as defined in section 200 of the National Vocational Education Training Regulator Act 2011.
TAFE SA lodged a reconsideration application with ASQA on 2 March 2018.
During ASQA’s review of the reconsideration application, it was noted that TAFE SA had expended significant effort and resources in order to successfully achieve compliance with the requirements of the VET Quality Framework and had cooperated with the regulator throughout the process.
ASQA’s review of TAFE SA’s reconsideration application found that TAFE SA had provided sufficient evidence that it had rectified significant non-compliances.
ASQA found that some minor non-compliances remained, and has issued a written direction that requires TAFE SA rectify each minor non-compliance within 20 working days.
ASQA also advised TAFE SA of its intention to undertake another compliance monitoring audit of its training and assessment during 2018.
